Disney is attempting to have a widower’s wrongful death lawsuit dismissed and sent to arbitration due to terms agreed to when he signed up for a Disney+ account. Jeffrey J. Piccolo filed a lawsuit against Disney Parks and Resorts after his wife, Dr. Kanokporn Tangsuan, died from a severe allergic reaction at a Disney World restaurant. Piccolo claims they repeatedly asked about accommodating her allergies at Raglan Road Irish Pub and Restaurant. Disney argues that Piccolo agreed to arbitration when signing up for Disney+ and purchasing tickets on the Walt Disney Parks website. Piccolo’s lawyers called Disney’s reasoning preposterous and unreasonable. They claim that signing up for a Disney+ account should not bar his right to a jury trial in this case. The complaint alleges negligence on the part of the restaurant and Disney Parks and Resorts, stating that despite reassurances from the server, Tangsuan had a severe allergic reaction and ultimately died at a local hospital. The autopsy report cited elevated levels of allergens in her system. The lawsuit seeks $50,000 in damages. Piccolo’s lawyers argue that he did not agree to arbitration for claims related to injuries sustained at a Disney restaurant through terms agreed to when signing up for Disney+.
